Billionaire Elon Musk’s political action committee (PAC) has received a warning from the US Justice Department regarding a $1 million daily giveaway contest that could potentially violate federal law, according to media reports on Wednesday.
Musk, known for his support of Donald Trump, launched the contest in Pennsylvania, one of seven critical swing states expected to play a decisive role in the upcoming US presidential election on November 5, 2024. The contest promises to award $1 million to one registered voter from a swing state every day until the election.
The Justice Department’s letter, as reported by CNN and 24sight News, cautioned Musk’s America PAC that such giveaways might breach federal law, which prohibits offering financial incentives in exchange for voter registration. Although the winners of the sweepstakes are chosen at random, they must be registered voters, and are also required to sign a petition supporting “free speech and the right to bear arms.”
Georgetown Law School professor Danielle Lang, an expert in election law, commented earlier in the week, warning that the contest could be subject to legal enforcement by the Justice Department. She emphasized that federal law prohibits offering money on the condition that individuals register to vote.
“This contest’s requirement that participants be registered voters in one of the seven swing states—or register if they are not—violates federal law,” Lang explained.
The Justice Department has not yet provided an official comment on the matter. However, this development adds to Musk’s growing involvement in the election, as he has also donated $75 million to a pro-Trump PAC and made appearances at campaign rallies in recent weeks.
Musk’s actions highlight his strong support for Trump in the race against Democratic candidate Kamala Harris for the 2024 US presidential election.
