Big news coming out of Nigeria: the Federal Competition and Consumer Protection Commission (FCCPC) recently slapped WhatsApp with a hefty $220 million fine for a data privacy violation. But what’s even more concerning is that this might just be the beginning of a bigger showdown between Meta (WhatsApp’s parent company) and the Nigerian government. There’s talk that WhatsApp could suspend operations in Nigeria altogether due to the FCCPC’s additional demands.
According to insiders, Meta is seriously considering pulling certain services from Nigeria. The FCCPC isn’t just demanding the fine—they’ve also ordered WhatsApp to stop sharing user data with other Facebook companies and third parties without explicit consent. On top of that, WhatsApp is expected to provide more transparency about data collection and restore user control over how their data is used.
In a statement to TechCabal, a WhatsApp spokesperson made it clear that complying with these demands might make it impossible to continue offering WhatsApp in Nigeria or even globally. They pointed out that the order misrepresents how WhatsApp operates and that the app relies on a certain level of data sharing to function and keep users safe. Meta is urgently appealing the order to avoid any impact on users.
Interestingly, Meta didn’t address the FCCPC’s claim that WhatsApp didn’t allow users to opt out of its 2021 privacy policy. Instead, they reiterated that their 2021 Privacy Policy update doesn’t include sharing user data and that keeping records for two billion users would be a significant privacy and security risk.
If WhatsApp does shut down in Nigeria, it could have serious repercussions for individuals and small business owners. Many SMEs in Nigeria rely heavily on WhatsApp, Instagram, and Facebook to connect with customers. The potential loss of WhatsApp could severely impact their operations.
The legal side of this issue is also up for debate. Three privacy lawyers questioned whether the FCCPC’s reliance on the National Data Protection Regulation (NDPR) from 2019 is strong enough to justify such a massive fine. Some experts even doubt whether a government regulation like the NDPR can hold up in court when it comes to privacy matters of this magnitude.
There’s also concern about the proportionality of the fine. Two government figures pointed out that the $220 million penalty might be more about revenue than about actual data protection. One industry expert questioned whether the government considered the opportunity cost of losing such a significant amount from the country’s economy.
